As background information, health supplement claims (“Claims”) comprise any forms of description that state, suggest or imply (menyiratkan) that there is a connection between the health supplements (“Supplements”) in question or their active materials and certain health benefits. All such Claims should be affixed by any legal entities or non-legal entities established in Indonesia that organize business activities within the Supplement sector (collectively referred to as “Business Actors”)[1] to the packaging of any Supplements that are circulated.[2] The affixation of these Claims should be implemented during the registration of Supplements and must be produced in accordance with the guidelines for Claims (“Claims Guidelines”), as set out under the new framework of Regulation of the National Agency of Drug and Food Control (Badan Pengawas Obat dan Makanan – “BPOM”) Regulation No. 19 of 2022 (“Regulation 19/2022”).[3]
