- The Directorate-General of Intellectual Property ("Directorate-General") at the Ministry of Law and Human Rights ("Ministry") engaged in discussions of Draft Regulation of the Minister of Law and Human Rights ("Draft Regulation") on Amounts, Requirements and Procedures for the Imposition of Non-Tax State Revenue (Penerimaan Negara Bukan Pajak – "PNBP") Tariffs at the Directorate-General between 15 - 16 August 2022.
- Among the 16 programs that are being organized during 2022 is one that is aiming to ensure that intellectual property is a supporter of national economic recovery and can drive scientific progress and cultural development through equitable PNBP. This program is being offered to business actors that are intending to register or protect their intellectual property through the Directorate-General but that are currently being constrained by costs.
- According to the Head of the Finance Division at Directorate-General, Cumarya, under the new program, an intellectual property service fee of Rp. 0.00 or 0% will be offered during various activities that support intellectual property programs, including the commemoration of the anniversary of the Ministry, Intellectual Property Day or other holidays that are observed at the Ministry. In order to support the equitable PNBP program, the Draft Regulation is being drawn up in line with the mandate set under Art. 24 of Regulation of the Government No. 69 of 2020.
- Reflecting on the statement made by Cumarya, Yayah Mariani, Secretary for the Legal and Human Rights Research and Development Agency, stated recently that PNBP makes a crucial contribution to the country’s overall development. Mariani went on to affirm that as a consequence of the country’s membership of the World Trade Organization ("WTO"), Indonesia must bring all of its laws and regulations that apply within the field of intellectual property rights into line with standards set under the Agreement on Trade Related Aspects of Intellectual Property Rights ("TRIPS Agreement"). According to Mariani, international standards set by the WTO and under the TRIPS Agreement must also become the basis for the determination of any PNBP tariffs, and an effective and efficient Draft Regulation represents an important part of this process.
