- In an attempt to ensure that the technical requirements that apply to cosmetics materials ("Materials") are in line with current scientific and technological developments within the cosmetics sector, the National Agency of Drug and Food Control (Badan Pengawas Obat dan Makanan – "BPOM") has issued Regulation of the BPOM No. 17 of 2022 ("Amendment") on the Amendment to Regulation of the BPOM No. 23 of 2019 on Technical Requirements for Cosmetics Materials ("Regulation 23/2019").
- The Amendment revises the official list of materials that are permitted for use in the following products: 1) Cosmetics, in relation to which materials are permitted for use in line with certain restrictions and usage requirements (as listed under Appendix I to the Amendment); 2) Colorings that are used in cosmetics products, excluding hair coloring (as listed under Appendix II to the Amendment); 3) Preservatives that are used in cosmetics products (as listed under Appendix III to the Amendment); and 4) Sunscreens that are used in cosmetics products (as listed under Appendix IV to the Amendment). Moreover, cosmetics businesses are prohibited from distributing any cosmetics products that are not in accordance with the determined restrictions, requirements and/or intended uses that are listed under Appendices I – IV to the Amendment.
- Any Materials and/or natural Materials that will be used as colorings, preservatives or sunscreens and that are manufactured in Indonesia may only be utilized after approvals have first been secured from the Head of the BPOM through the Director of Standardization for Traditional Medicine, Health Supplements and Cosmetics ("Director"). In order to secure such an approval, cosmetics businesses should submit electronic applications for assessments of the safety, benefits and/or usage quality of the relevant Materials to the Director in order for said Materials to be subsequently assessed. Said applications should also enclose various technical and administrative documents.
- It should also be noted that cosmetics businesses that secured distribution licenses in the form of notifications prior to 28 July 2022 should bring their operations into line with the provisions set out under the Amendment within two years of said date.
- The Amendment has been in force since 28 July 2022.
