Post-Delegation of Certain Mining Permits to Regional Governments: Environmental Approvals to Be Issued by Governors

As a follow-up to the introduction of Regulation of the President No. 55 of 2022 on the Delegation of the Granting of Business Licenses Within the Field of Mineral and Coal Mining ("Regulation 55/2022"), the Director of the Prevention of Environmental Impact for Business and Activities has issued Letter No. S.1617/PDLUK/P2T/PLA.4/6/2022 on the Authorization of Environmental Permits for Mining Activities Post-Issuance of Regulation 55/2022 ("Letter").
As the issuance of certain permits that apply within the mining sector has been now delegated to regional governments, the Letter confirms that in terms of any business and/or activities for which the issuance of business licenses has been delegated to regional governments based on Regulation 55/2022 (for more information, see the following analysis: “Regional Governments Now Permitted to Issue Mining Licenses”), the corresponding environmental approvals should now be issued by the relevant governors. As a result, all related business actors may coordinate with the Environment and Forestry Offices located in the relevant provinces.
The Letter has been in force since 13 June 2022.
