Govt. Clarifies Licensing Mechanism for the Construction and/or Placement of Buildings and Installations at Sea

In an attempt to minimize any overlapping utilization of sea areas, as well as to provide greater certainty and boost business sustainability and investments in relation to activities that are undertaken at sea, the Minister of Marine Affairs and Fisheries has issued Decree No. 42 of 2022 on the Organizing Mechanism for the Construction and/or Placement of Buildings and Installations at Sea (“Decree 42/2022”).[1]

In essence, Decree 42/2022 integrates and clarifies the mechanisms for the issuance of basic business license requirement in the form of approval or confirmation on the Conformity of Sea-Areas Utilization Activities (Kesesuaian Kegiatan Pemanfaatan Ruang Laut – “KKPRL”) and, ultimately, for the construction and/or placement of buildings and installations at sea in relation to the following activities: [2]
