- In a bid to realize the formulation and introduction of planned, integrated and sustainable laws and regulations, as well as to specifically address the omnibus method in relation to the formulation of laws and regulations and to strengthen meaningful community engagement and participation in related processes, the House of Representatives (Dewan Perwakilan Rakyat/DPR) recently passed the Bill on the Second Amendment to Law No. 12 of 2011 on the Establishment of Laws and Regulations ("Bill") into law.
- The omnibus law method has been introduced under the Bill and is defined as a method of drafting laws and regulations through: 1) The inclusion of new content; 2) Amendments to content material that has relevance and/or legal requirements regulated across various laws and regulations of the same type and hierarchy; and/or 3) Revocation of laws and regulations of the same type and hierarchy by combining them under the framework of a single piece of legislation in order to achieve certain goals.
- The use of the omnibus method in order to establish draft laws and regulations must be specified in the relevant planning documents. Moreover, the content of any materials that are regulated under laws and regulations that are drafted through the use of the omnibus method may only be changed and/or revoked by changing and/or revoking the relevant laws and regulations.
- The general public has the right to provide oral and/or written input during each stage of the establishment of laws and regulations and said input may be delivered through both online and/or offline means. Specifically, the general public concerned comprises individuals or groups of persons who will be directly affected by and/or that have an interest in the material contained within draft laws and regulations. In order to make it easier for the general public to provide such input, all academic manuscripts and/or draft laws and regulations should be easily accessible.
- The “principle of openness” means that the establishment of laws and regulations through their planning, drafting, discussion, ratification, determination and enactment, including monitoring and review processes, should be accessible to members of the general public who have an interest in said matters and who will be directly affected by them. Said members of the general public should be able to obtain information and/or provide input during each stage of the establishment of laws and regulations, either orally and/or in writing via both online and/or offline means.
