BPJS Kesehatan Participant Cards to Become Requirement for Services Relating to Transfers of Land and Ownership Titles

  • As originally mandated under Directive of the President No. 1 of 2022 on the Optimization of the Implementation of the National Health Guarantee Program, the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency ("Minister") are required to ensure that all applicants for the registration of land-rights transfers due to the completion of sales and purchases are active participants in the National Health Security (Jaminan Kesehatan Nasional – "JKN") program.
  • Moreover, Minister, through the issuance of Letter No. HR.02/153-400/II/2022 ("Letter 153"), has now stated that the JKN program is an integral part of Indonesia’s national social security program and that all residents, including foreign citizens who have been working in Indonesia for a minimum period of six months are therefore required to become participants in this program.
  • As a result of this requirement, all applications for registration services for transfers of land rights or freehold titles for multistory housing units relating to sales and purchases should be submitted along with a copy of a participant’s card for the Social Security Agency for Health (Badan Penyelenggara Jaminan Sosial Kesehatan/BPJS Kesehatan).
  • Finally, as part of the implementation of said registrations, the Minister, through the issuance of Letter No. HR .02/164-400/II/ 2022 ("Letter 164"), has stated that any applications relating to such matters which have already been duly received and which have fulfilled the relevant requirements should be settled in accordance with the provisions that were in place prior to the enforcement of Letter 164. The various provisions addressed under Letter 164 and Letter 153 officially come into force on 1 March 2021.
