- In order to ensure sufficient supplies of coal for use by Indonesia’s domestic power plants, the Indonesian Government has temporarily prohibited exports of coal from 1 January 2022 - 31 January 2022. This prohibition on coal exports applies to holders of Mining Business Licenses (Izin Usaha Pertambangan/IUP), Special Mining Business Licenses (Izin Usaha Pertambangan Khusus – "IUPK") for production operations, and IUPK as a continuation of Operation Contracts of Work (Kontrak Karya/KK) or Coal Contracts of Work (Perjanjian Karya Pengusahaan Pertambangan Batubara – "PKP2B").
- This prohibition has been implemented as a result of a deficit in supplies of coal to domestic power plants. In addition, the government has also issued Decree of the Minister of Energy and Mineral Resources No. 139.K/HK.02/MEM.B/2021, which specifically addresses the obligation to ensure that domestic coal supply requirements are met.
- The government has emphasized that is vital to ensure the adequacy of Indonesia’s domestic coal supply in order to maintain national economic stability and the country’s overall investment climate. It is thus imperative that the relevant business actors ensure that they comply with this temporary prohibition. (ANT)
