Govt. Provides Details on the Implementation of Forest and Land Rehabilitation Efforts

The Minister of Environment and Forestry (“Minister”) has finally issued Regulation No. 23 of 2021 on the Implementation of Forest and Land Rehabilitation (“Regulation 23/2021”), which specifically addresses the following aspects of Forest and Land Rehabilitation (Rehabilitasi Hutan dan Lahan – “RHL”) efforts: 1) RHL implementation procedure; 2) RHL supporting activities; 3) Supervision and control; and 4) Financing.
The implementation of RHL is divided into two parts. The first part comprises the implementation of the Forest Rehabilitation Program, which involves reforestation and/or the implementation of soil conservation techniques. Through this program, business actors may create/provide seeds in order to support the reforestation and/or organization of the implementation of soil conservation techniques and activities, as sanctioned by local regional government officials.
The second part of RHL comprises the implementation of the Area Rehabilitation Program, which involves greening efforts and/or the implementation of soil conservation techniques. These programs may be implemented by: 1) Relevant provincial governments (on land which does not place any burden upon any existing rights); and 2) Holders of the relevant rights.
As part of RHL supporting activities, business actors are also obliged to participate in counselling sessions held by Non-Governmental Forestry Counsellors (Penyuluh Kehutanan Swadaya Masyarakat).
Regulation 23/2021 has been in force since 1 December 2021.
