- The Minister of Environment and Forestry (“Minister”) has finally issued Regulation No. 23 of 2021 on the Implementation of Forest and Land Rehabilitation (“Regulation 23/2021”), which specifically addresses the following aspects of Forest and Land Rehabilitation (Rehabilitasi Hutan dan Lahan – “RHL”) efforts: 1) RHL implementation procedure; 2) RHL supporting activities; 3) Supervision and control; and 4) Financing.
- The implementation of RHL is divided into two parts. The first part comprises the implementation of the Forest Rehabilitation Program, which involves reforestation and/or the implementation of soil conservation techniques. Through this program, business actors may create/provide seeds in order to support the reforestation and/or organization of the implementation of soil conservation techniques and activities, as sanctioned by local regional government officials.
- The second part of RHL comprises the implementation of the Area Rehabilitation Program, which involves greening efforts and/or the implementation of soil conservation techniques. These programs may be implemented by: 1) Relevant provincial governments (on land which does not place any burden upon any existing rights); and 2) Holders of the relevant rights.
- As part of RHL supporting activities, business actors are also obliged to participate in counselling sessions held by Non-Governmental Forestry Counsellors (Penyuluh Kehutanan Swadaya Masyarakat).
- Regulation 23/2021 has been in force since 1 December 2021.
