Law on Roads to Be Revised to Improve Road Services and Accelerate Infrastructure and Economic Development Across the Regions

  • The Minister of Public Works and Public Housing, Basuki Hadimuljono, recently revealed that the revision of Law No. 38 of 2004 on Roads ("Law 38/2004"), which will soon be ratified by the House of Representatives (Dewan Perwakilan Rakyat – "DPR"), is aiming to improve Indonesia’s road services.
  • Broadly speaking, the points stipulated under the Draft Bill on the revision to Law 38/2004 encompass the authority to administer roads, budgeting, toll-road concessions, land acquisition and the role of civil servant investigators when examining allegations of crimes committed within the roads sector.
  • Previously, Suryadi Jaya Purnama, a member of Commission V at the DPR, emphasized that the revision of Law 38/2004 was important in order to reduce regional disparities and to promote equitable development throughout Indonesia.
  • Mr. Purnama went on to state that, to date, both provincial and district and city governments have not been able to finance all of the required infrastructure development within their regions. However, roads in villages, regencies and provinces that remain in a poor condition due to an inability to finance renewal programs will in the future be able to access the state budget so that the acceleration of infrastructure and economic development across the regions is both equitable and fair.
