Govt. Introduces New Regulation on Immigration Consultants

  • In order to improve the quality of the available immigration sector services, the Minister of Law and Human Rights recently issued Regulation No. 35 of 2021 on Immigration Consultants ("Regulation 35/2021"). In general, this regulation addresses the roles, working procedures, registration, determination and training of, as well as the obligations of and prohibitions on immigration consultants.
  • The role of immigration consultants is to provide consultation services and assistance to immigration service applicants (i.e. Indonesian citizens, foreign citizens and guarantors). The obligations of immigration consultants break down as follows: 1) Provision of consultation services within the immigration sector; 2) Protection and security of the confidentiality of applicants’ data; 3) Submission of monthly reports on the immigration services provided; 4) Ensuring the accuracy of all data and information relating to immigration service applications and settlements; etc.
  • In order to provide such services, immigration consultants must be working for various types of immigration consultation offices (e.g. law offices, travel agencies, umrah/hajj travel agencies). Said offices must fulfill the following requirements: 1) Must take the form of legal entities; 2) Must be registered with the Ministry of Law and Human Rights; and 3) Must possess adequate facilities and infrastructure.
  • Applications to register as immigration consultation offices should be submitted to the Director-General of Immigration by either electronic or non-electronic means. Said registrations are conducted through the submission of relevant data and various documents, including the following: 1) Application letter; 2) ID card and taxpayer number of the head of the relevant company; 3) Checking account or passbook for an account which contains a certain balance; 4) Business license number; 5) Certificate of immigration consultation training, etc.
  • Regulation 35/2021 comes into force on 20 December 2021.
