- The Minister of Manpower recently issued Circular No. M/11/HK.04/IX/2021 on the Authorization Service for Plans for the Utilization of Foreign Workers During the Handling of the Spread of Corona Virus Disease 2019 ("Circular"), which simultaneously repeals and replaces Circular of the Minister of Manpower No. M/3/HK.04/II/2021.
- Businesses who utilize foreign workers (Tenaga Kerja Asing – "TKA") may now submit requests for the authorization of official Plans for the Utilization of Foreign Workers (Rencana Penggunaan Tenaga Kerja Asing – "RPTKA"), as long as said utilization is being sought for any of the following reasons: 1) Activities relating to nationally strategic projects and objects of vital national importance, based on recommendations made by the relevant ministries; or 2) Special and urgent reasons, based on recommendations made by the relevant ministries/agencies.
- Requirements for the submission of limited-stay visa applications for TKA shall be determined in accordance with laws and regulations that apply within the immigration sector.
- RPTKA will not be approved for any TKA coming to Indonesia from countries with high rates of COVID-19 infection, as mandated by the Minister of Law and Human Rights. However, businesses who utilize TKA may now submit applications for extensions of the authorization of RPTKA for any TKA who are still in Indonesia.
- This Circular has been in force since 24 September 2021.
