New Waste-Bank Provisions Introduced

  • In an attempt to establish a more synergized waste-management regime that involves the use of waste banks, the Minister of Environment and Forestry (“Minister”) recently issued Regulation No. 14 of 2021 on Management of Wastes on Waste Banks (“Regulation 14/2021”), which addresses a set of updated norms, standards, procedures, criteria, facilities and partnership development standards relating to the management of waste, specifically through waste banks.
  • During the implementation of waste management, the government and the public may create waste banks, a type of facility that is used in order to manage waste through the application of the reduce, reuse and recycle principles. However, any waste bank which will be put into operation must satisfy various requirements that relate to the following aspects: 1) Waste management, which comprises waste reduction and waste handling activities; 2) Waste bank facilities, the requirements for which differ based on waste-bank types, specifically waste bank units (bank sampah unit – “BSU”) and central waste banks (bank sampah induk – “BSI”); and 3) Waste bank governance, the requirements for which are also different for BSU and BSI.
  • The central government and regional governments may facilitate cooperation between waste banks and the following parties: 1) Parties that operate recycling businesses and/or activities; and/or 2) Producers.
  • Ultimately, organizers of waste banks may be granted incentives if they demonstrate good performance.
  • Regulation 14/2021 has been in force since 1 July 2021.
