Claims Emerge That Tobacco Industry Employees at Risk from Regulatory Revision

  • The Chairman of the Labor Union Federation of Tobacco, Cigarettes, Food and Beverages (Federasi Serikat Rokok Tembakau Makanan Minuman – "RTMM"), Sudarto, has requested that Indonesian President, Joko Widodo, cancel the proposed revision of Regulation of the Government No. 109 of 2012 on the Health Control of Materials Containing Addictive Substances in the Form of Tobacco Products ("Regulation 109/2012").
  • Under the proposed revision, health warnings on packaging are set to be increased up to 90% of total surface area (up from the previous lower limit of 40%), while the advertising and promotion of such products will be strictly prohibited. The ultimate goal of these new measures is to reduce the number of child smokers in Indonesia. According to Mr. Sudarto, the prohibition on cigarette sales to children and the posting of warnings that specifically addressed expectant mothers was previously addressed under Regulation 109/2012 and succeeded in decreasing the number of adults smokers across the population to a level of 28.8% in 2018 (down from the previous figure of 29.3% posted in 2013).
  • Mr. Sudarto has also asserted that any such revision of the prevailing regulatory framework for tobacco products may lead to significant pressure being exerted upon the Tobacco Product Industry (Industri Hasil Tembakau – "IHT") on top of the difficulties that are already being experienced as a result of the ongoing Corona Virus Disease 19 (COVID-19) pandemic. Mr. Sudarto further concluded that the proposed tightening of the current regulatory framework for tobacco products may ultimately lead to large numbers of layoffs among IHT employees, which will add to the country’s current unemployment figure of 9.7 million.
  • In order to ensure the continued viability of the IHT sector and its many employees, the RTMM is also requesting the preparation of customs policies that take both the industry’s capabilities and the purchasing power of the general public into consideration. (ANT)
