Deadline for Registration of Private-Sector Electronic Systems Providers Extended

  • In order to protect Indonesian citizens during their interactions within the digital world, the Ministry of Communication and Information Technology (“Ministry”) is currently implementing three policies which relate to Regulation of the Minister No. 5 of 2020 on Private-Sector Electronic System Providers (“Regulation 5/2020”), specifically as it addresses the following areas: 1) The obligation of Electronic System Providers (Penyelenggara Sistem Elektronik – “PSE”) to complete official registrations; 2) Content moderation; and 3) Granting of access to surveillance and law-enforcement apparatuses.
  • Mr. Semuel A. Pangerapan, Director-General of Information and Communication Technology Applications at the Ministry has further elaborated that registrations of private PSE should be carried out via an Online Single Submission – Risk-Based Approach (“OSS-RBA”) system managed by the Ministry of Investment/the Investment Coordinating Board, which is planned to commence operations on 2 June 2021. Consequently, the original deadline for private PSE registrations of 24 May 2021 that was set in accordance with Regulation 5/2020 has now been adjusted and extended to six months from the date upon which the new OSS-RBA system comes online.
  • Mr. Pangerapan went on to assert in his statement that Regulation 5/2020 should be implemented in line with the protection of the right to privacy, personal data and freedom of expression. (KOMINFO)
