The Granting of Government Guarantees to Accelerate the Implementation of National Strategic Projects Updated

Infrastructure and Construction Services

The Minister of Finance (“Minister”), Sri Mulyani Indrawati, recently issued Regulation No. 30/PMK.08/2021 on the Procedure for the Granting of Central Government Guarantees for the Acceleration of the Implementation of National Strategic Projects (“Regulation 30/2021”), which sets out an updated framework that accommodates various changes and requirements in relation to the provision of government guarantees in order to accelerate the implementation of national strategic projects (proyek strategis nasional – “PSN”) and to encourage more investors become involved in PSN.
The various updates set out under Regulation 30/2021 encompass the following areas: 1) Involvement of the Infrastructure Guarantee Agency (Badan Usaha Penjaminan Infrastruktur – “BUPI”) in the granting of government guarantees; and 2) Stricter definition of the scope of political risks in terms of PSN guarantees.
In terms of the involvement of BUPI, the granting of government guarantees can now be conducted through the following schemes: 1) Direct granting of guarantees by the government alone; 2) Granting of guarantees by both BUPI and the government; and 3) Granting of guarantees by BUPI alone. _(setkab)
