Supreme Court Officially Ban Fees for Advocate Oath-Taking Ceremonies

  • The Indonesian Supreme Court (Mahkamah Agung – “MA”) recently issued Circular of the MA No. 3 of 2021 on the Prohibition on Levies Relating to Advocate Oath-Taking and Pledges (“Circular 3/2021”) as part of efforts aimed at creating so-called “integrity zones”, Corruption Free Areas (Wilayah Bebas Korupsi/WBK) and Clean and Efficient Bureaucratic Areas (Wilayah Birokrasi Bersih Melayani/WBBM) within the institution.
  • According to Circular 3/2021, advocate oath-taking and pledges will be conducted in high courts in the relevant domiciles while any collection of fees in relation to the implementation of advocate oath-taking and pledges is now strictly forbidden unless otherwise stipulated under relevant laws and regulations.
  • The response to Circular 3/2021 from a number of advocates’ organizations has been largely positive so far. Indeed, the Indonesian Advocates Association (Perhimpunan Advokat Indonesia – “Peradi”), Rumah Bersama Advokat, Suara Advokat Indonesia and the Peradi National Leadership Council (Dewan Pimpinan Nasional/DPN) have all expressed their support for the implementation of Circular 3/2021. Suara Advokat Indonesia in particular is committed to updating their current standardized announcements for the registration of appointments and the taking of advocate oaths and pledges.
