Regulation of the Government No. 22 of 2021 on the Implementation of Environmental Protection and Management

  • The scope of the various provisions which are included under this regulation encompasses the following areas: 1) Environmental approvals; 2) Protection and management of water quality; 3) Protection and management of air quality; 4) Protection and management of the quality of marine environments; 5) Control of environmental damage; 6) Management of hazardous and toxic substance (Bahan Berbahaya dan Beracun – “B3”) waste and non-B3 waste; 7) Guarantee fund for the restoration of environmental functions; 8) The environmental information system; 9) Development and supervision; and 10) The imposition of administrative sanctions. By way of comparison, this regulation has now broadened the scope of the various provisions that it includes in comparison with the previously published Draft Regulation of the Government.
  • Environmental approvals must be secured by all businesses and/or in relation to all activities that have either significant or insignificant impacts upon the environment. The securing of said environmental approvals is a prerequisite for the issuance of other business licensing documents and government approvals.
  • The protection and management of water quality, air quality and the quality of marine environments are to be implemented by different parties (e.g. the Minister of Environment and Forestry or relevant governors in relation to the protection and management of marine environments) and comprise different activities, which encompass planning, utilization, control and maintenance (with the exception of the protection and management of air quality).
  • All parties that generate waste are required to manage the waste they produce, including the management of B3 waste and non-B3 waste. Said management activities differ based on the types of waste that are being managed (i.e. B3 waste or non-B3 waste).
  • This regulation has been in force since 2 February 2021 and can be accessed here.
