Ministry of ATR/BPN Set to Issue Five New RPP to Job Creation Law

  • In the wake of the issuance of Law No. 11 of 2020 on Job Creation (“Job Creation Law”), The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (“Ministry”) recently completed drafts of five Regulations of the Government (Rancangan Peraturan Pemerintah – “RPP”), specifically: 1)  RPP on Spatial Management; 2) RPP on the Land Bank; 3) RPP on Management Rights, Land Rights, Apartment Units (Sarusun) and Land Registrations; 4) RPP on the Implementation of Land Acquisitions for Developments in the Public Interest; and 5) RPP on Areas and Control of Abandoned Land.
  • It is expected that these five new RPPs will ultimately revise the following existing Regulations of the Government (Peraturan Pemerintah – “PP”): 1) PP No. 40 of 1996 on Business Use Rights, Building Use Rights and Land Use Rights; 2) PP No. 24 of 1997 on Land Registrations; and 3) PP No. 103 of 2015 on the Ownership of Residences and Residential Homes by Foreign Citizens.
  • The RPP on Management Rights, Land Rights, Apartment Units (Sarusun) and Land Registrations will primarily address advances in land affirmation, including the following areas: 1) Strengthening of management rights; 2) Utilization of economic documents during land registrations; 3) Implementation of the mandatory Complete Systematic Land Registration Program; and 4) Acceleration of announcement periods.
