Indonesian Government Introduces Tax Facilities in Bid to Accelerate Procurement of COVID-19 Vaccine

  • Through the issuance of Regulation of Minister of Finance (“Minister”) No. 188/PMK.04/2020 on the Granting of Customs and/or Excise and Taxation Facilities for Procurements of Imported Vaccines to Mitigate the Corona Virus Disease 2019 Pandemic, the government has now decided to exempt procurements of vaccines within Indonesia from the imposition of import duty.
  • The Director-General of Customs and Excise, Syarif Hidayat, has revealed that this tax facility will apply to all imports of vaccines, vaccine materials and production equipment, as well as to vaccination equipment.
  • Furthermore, Mr. Hidayat has also stated that the above-mentioned facilities comprise the following elements: 1) Import-duty and/or excise exemptions; 2) Non-collection of value-added tax (pajak pertambahan nilai/PPN) and luxury goods sales tax (pajak pertambahan nilai barang mewah/PPnBm); and 3) Non-collection of Article-22 income tax (pajak penghasilan/PPh).
  • In addition, the government has also decided to ease the procedural mechanism for releases of goods through fast-tracked handling by allowing for the submission of prior applications along with the preparation of supporting customs documents and guarantees.
  • If parties looking to secure these facilities are either central or regional government-related, then requests must be submitted to the Minister enclosing details of the relevant types and quantities of goods along with their estimated customs values. Meanwhile, if requests are submitted by legal entities or non-legal entities then the following documents must be enclosed: 1) Assignment and recommendation issued by the Minister of Health; 2) Business Identification Number or Taxpayer Identification Number.
