DPR Proposes Draft Bill on the Prohibition of Alcoholic Beverages Again

  • Illiza Sa’aduddidn Djamal, a member of Commission X at the House of Representatives, has proposed the formulation of a Draft Bill on the Prohibition of Alcoholic Beverages (“Draft Bill”) in order to protect the general public from and raise awareness of the perceived dangers of alcohol.
  • Illiza has offered four arguments as to why the development of a Draft Bill is urgently needed, specifically: 1) From a philosophical perspective, a prohibition on alcoholic beverages is required in order to embody the values of Pancasila and the constitution; 2) From a social perspective, an increasing number citizens are dying from the effects of alcohol, as well as becoming victims of alcohol-related crime; 3) From a formal judicial perspective, the current provisions which address the prohibition on alcoholic beverages in certain circumstances, as set out under the Indonesian Criminal Code, are seen as inadequate; and 4) Legal-development perspective.
  • In essence, the prohibition which has been proposed for inclusion under any Draft Bill should address the following matters: 1) Prohibition on Muslims or persons of other religions producing, importing, storing, distributing and/or selling all types of alcoholic beverages; and 2) Only allowing persons of a minimum age of 21 years to buy and/or consume alcoholic beverages. Moreover, alcoholic beverages should only be sold in certain permitted places, as addressed under the relevant laws and regulations. (ANT)
