- The Financial Services Authority (Otoritas Jasa Keuangan – “OJK”) recently pledged to ensure that future regulations adhere to provisions set out under the Draft Bill on Personal Data Protection (“Draft Bill”), which is still currently being deliberated by the Indonesian House of Representatives (Dewan Perwakilan Rakyat – “DPR”).
- In this context, the OJK is specifically referring to Regulation of the OJK No. 77/POJK.01/2016 on Technology-Based Fund-Lending Services, which is scheduled to receive an update that will specifically address the current personal data protection rules some time in late 2020 or early 2021.
- In terms of the development of the Draft Bill, the DPR recently agreed to extend its deliberations up until the closing of the second session. Furthermore, each DPR faction is currently in the process of compiling official inventory lists of problems (Daftar Inventarisasi Masalah).
- The OJK is also currently coordinating with communications service providers in an effort to quell the sending of SMS-based messages and offers by Fintech lending players, with an eye on implementing a regulatory framework that specifically limits or prohibits such SMS-based offers in the near future.
