Regulation of Minister of Environment and Forestry No. P.18/MENLHK/SETJEN/KUM.1/8/2020 on the Utilization of Hazardous and Toxic Waste

Mandates that all parties that produce hazardous and toxic waste (limbah bahan berbahaya dan beracun – “B3 Waste”) should utilize said B3 Waste as substitute raw materials and energy resources, as raw materials, in accordance with scientific and technological developments.
In order to be able to engage in the utilization B3 Waste, as outlined above, relevant parties are first required to secure B3 Waste Management Licenses which specifically address the utilization of B3 Waste, as described under Regulation of Minister of Environment and Forestry No. 18 of 2009 on Licensing Procedures for the Management of Hazardous and Toxic Waste. However, certain B3 Waste management activities (i.e. the reuse of self-produced B3 Waste produced through closed systems, the non-continuous reuse of B3 Waste in limited amounts, etc.) may be exempted from the requirement to secure a mandatory business license.
