- The Director-General of Informatics Applications at the Ministry of Communications and Informatics (“Ministry”), Semuel Abrijani Pangerapan, recently issued a statement affirming that the strengthening of the country’s regulatory frameworks will be a crucial element in accelerating Indonesia's digital transformation, specifically in terms of the creation of digital infrastructure and applications. The regulations in question encompass the Law on Electronic Information and Transactions, the Law on the Organization of Electronic Systems and Transactions, the Draft Bill on Personal Data Protection, the Draft Bill on Job Creation, Regulation of the President on Single Data and Regulation of the President on the Single Map.
- In order to achieve the target of all Indonesian villages being able to access 4G by 2022, the Ministry is in currently working on several infrastructure projects, including the Palapa Ring, which encompasses both marine- and land-based optical fiber; so-called “middle-mile” technologies such as microwaves and radio links; and “last-mile” technologies such as Base Transceiver Stations (BTS), Fiber to the Home (FTTH) and broadband wireless.
- Mr. Pangerapan has also reaffirmed that, according to the existing framework of Government Regulation No. 71 of 2019, digital applications are divided up into public and private, although applications of both types which are circulated and used within Indonesia must be officially registered. Public applications currently include, among others, Gojek, Traveloka, Tokopedia, Bukalapak, Google, Facebook, YouTube, Twitter and Tiktok. Meanwhile, private government applications include PeduliLindugi, Lapor.id, LPSE, Simonas, DJP, Jaga and several others. If applications do not declare what data they collect, as well as where and why said data is to be used, then they will not be allowed to register or operate within Indonesia.
- The Draft Bill on Personal Data Protection, which stipulates said obligation to register, is set to proceed to the second hearing phase at Indonesia’s House of Representatives next week. (KOMINFO)
