Personal-Data Breach Cases Spike during COVID-19 Pandemic

  • One of the effects of the ongoing Corona Virus Disease 2019 (“COVID-19”) pandemic has been a shift in the general public’s behavior from offline to online activities. However, according to Ira Aprilianti, a researcher at the Center for Indonesia Policy Studies (CIPS), this shift has been accompanied by an increased risk of personal-data leaks. Indeed, cases involving breaches of personal data doubled between January and April of 2020, ultimately resulting in losses of approximately IDR 10.84 billion.
  • As a result, the Minister of Communications and Informatics, Johnny Plate, recently ordered a number of telecommunications providers to investigate allegations relating to breaches of consumers’ personal data. Furthermore, Mr. Plate has also reemphasized the fact that all of the country’s telecommunications providers are subject to a regulatory framework under which businesses must ensure the protection of consumers’ personal data and must also possess ISO 27001 certification at the minimum in relation to the security of their systems.
  • The Director of Partnership and Collaboration at the Law and Policy Study Center (Pusat Studi Hukum dan Kebijakan) also stated recently that the scope of the various parties required to comply with this regulatory framework should include businesses entities since businesses often act in the role of data controllers in relation to their customers. The director went on to add that the scope of the regulatory framework should not only address domestic data matters but should also be international in its sweep.
