Business Licensing Simplified under Draft Omnibus Law on Job Creation

  • Under the forthcoming Draft Omnibus Law on Job Creation (“Draft Bill”), business licensing will adopt a standard, risk-based approach which will categorize business activities as follows: 1) High-risk businesses, which require certain licenses (i.e. licenses which address health impacts, safety, environmental factors and natural resource management);  2) Moderate-risk businesses, which require standard compliance through certification; and 3) Low-risk businesses, which only require businesses to implement the relevant registration processes.
  • The Draft Bill categorizes businesses into a number of different sectors, which include: 1) Agriculture; 2) Forestry; 3) Fisheries and maritime; 4) Energy and mineral resources; 5) Nuclear; 6) Industry; 7) Trade; 8) Food and drug health; 9) Education; 10) Public works and housing; and so forth.
  • In addition to the abovementioned business sectors, the Draft Bill also lists several business sectors which are closed to investment, specifically: 1) Cannabis cultivation; 2) The catching of prohibited species of fish; 3) Coral extraction (pengambilan koral); 4) Gambling and casino businesses; 5) Chemical weapons; and 6) Production of Chlor-Alkali through the mercury process.
