- In view of the fact that the procedure which has to be followed in order to obtain an Environmental Impact Analysis (Analisis Mengenai Dampak Lingkungan – “AMDAL”) and a Building Construction Permit (Izin Mendirikan Bangunan – “IMB”) tend to prolong the whole business licensing process, the Minister of Agrarian Affairs and Spatial Planning/Head of National Land Agency (“Minister”) is planning to eliminate the obligation for businesses to obtain these documents, ultimately replacing them with Detailed Spatial Plans (Rencana Detail Tata Ruang – “RDTR”).
- A number of elements of the new RDTR are deemed by the Minister to be substantially similar to elements of AMDAL and IMB. In addition, the RDTR has been integrated into the Online Single Submission (OSS) system, which the Minister asserts should help to establish a more efficient licensing process.
- However, a number of parties have voiced their opposition to the Minister’s plan, including the Mayor of Bogor, Bima Arya, who fears that the elimination of both the AMDAL and IMB will only exacerbate the current chaos that prevails in relation to spatial planning and the construction sector. Concerns have also been raised by Jakarta’s Assistant Deputy Governor, Vera Revina Sari, who has claimed that the AMDAL and IMB do not share substantial similarities with the new RDTR. Indeed, according to Ms. Sari, the RDTR is only a planning document, while the IMB covers more of a control-related function.
- Based on their concerns, both Mr. Arya and Ms. Sari are urging the government to simplify the current licensing bureaucracy, instead of simply eliminating the AMDAL and IMB.
