- The Head of the Legal Bureau at the Ministry of Manpower, Budiman, stressed in a recent statement that the newly introduced Decree of the Minister of Manpower No. 228 of 2019 on Certain Positions Which May Be Occupied by Foreign Workers (“Decree 228/2019”) was issued with the intention of simplifying and codifying under a single framework various previously scattered legal frameworks which address available positions for foreign workers (“TKA”) .
- In his statement, Budiman explained that Decree 228/2019 adds, deletes and adjusts a variety of positions which may be occupied by TKA in comparison with the previous regulations, based on proposals which were drawn up by various ministries and institutions.
- However, Timboel Siregar, Secretary-General of the Indonesian Workers Organization (Organisasi Pekerja Seluruh Indonesia/“OPSI”) has argued that Decree 228/2019 is in contradiction with Articles 42 - 49 of the current Manpower Law, which tightly restricts the recruitment of TKA to a small number of positions while also prioritizing domestic workers. Under the new framework, a greater number of positions will become available to TKA and thus Mr. Siregar asserts that job opportunities for domestic workers will ultimately be further reduced.
