KPI Requires Legal Basis for Supervision of New Media

  • The Indonesian Broadcasting Commission (Komisi Penyiaran Indonesia – “KPI”) is hoping to extend its supervisory authority to encompass content which is posted via new media platforms such as Facebook, YouTube and Netflix (collectively referred to as “New Media”), as said platforms can be categorized as hosting broadcasting objects. The KPI is therefore now hoping to address the topic of New Media supervision under a forthcoming revision of the broadcasting law, as well as through the official Guidelines for Broadcasting and Standards for Broadcasting Programs.
  • The Ministry of Communication and Information Technology (“Ministry”) has confirmed that the KPI has no authority to supervise the content of any New Media under the current broadcasting law and that the scope of its supervisory authority only stretches to so-called “free-to-air” content.
  • The Minister of Communication and Information Technology, Rudiantara, has further claimed that the KPI must first specify the various types of objects that will fall under its supervision. However, the Minister has also stated his belief that the methods of censorship which are employed for films will not prove effective if implemented in relation to New Media content.
  • Voicing a similar opinion, Maman Suherman, a social observer, has suggested that the KPI should focus on the supervision of television and radio content in accordance with its current authority, while the supervision of New Media content requires more detailed provisions and should, therefore, be addressed under a whole new law.
