Interlocking Directorates Involving Garuda Airlines Group Investigated in Relation to Alleged Price Fixing Cartel

  • A number of interlocking directorates (rangkap jabatan) which involve employees of Garuda Airlines Group (i.e. Garuda, Citilink and Sriwijaya) are currently being investigated by Business Competition Supervisory Commission (“KPPU”) investigators in relation to alleged cartel practices involving the prices of airfares.
  • Three individuals are presently under the direct supervision of the KPPU in relation to interlocking directorates, specifically: 1) I Gusti Ngurah Askhara, who is currently the Executive Director of Garuda while also sitting on the Board of Commissioners (“BoC”) of Sriwijaya; 2) Pikri Ilham Kurniansyah, who is currently the Commercial Director of Garuda while also sitting on the BoC of Sriwijaya; and 3) Juliandra Nurtjahyo, who is currently the Executive Director of Citilink while also sitting on the BoC of Sriwijaya.
  • In his defense of his dual roles, Askhara recently reiterated that his appointment to two interlocking positions is in compliance with prevailing rules and procedures. In addition, Askhara also stressed that his appointment was necessary for the purpose of recovering state assets and had been approved by the Minister of State-Owned Enterprises. Nevertheless, Askhara could ultimately face a fine of up to IDR 25 billion.
