Draft Bill on Personal Data Protection is Pushed to be Passed this Year

  • Recently, the government had just concluded the synchronization of Draft Bill on Personal Data Protection (“Draft Bill”) and the Draft Bill is now currently being forwarded to the House of Representatives (“House”). Both the House and the government expect that the Draft Bill can be passed before the current House’s service period ends on 30 September 2019.
  • However, at least there are several deliberation stages that must be undergone for the Draft Bill to pass, including: 1) Deliberation at Deliberation Body (“Bamus”) of the House; and 2) First-level deliberation by the House which is predicted to take a long time.
  • If passed, Draft Bill will be relevant to the following sectors: 1) General election, especially the use of Indonesian citizenship number (“NIK”); 2) Financial technology (“Fintech”), specifically relating to disclosure of users’ personal data; and 3) E-commerce, with the focus on misuse of personal data.
