- To date, the Jakarta Legal Aid Institute (“LBH Jakarta”) has received 1,330 complaints filed by online loan victims from 25 provinces all across Indonesia. According to Jeanny Silvia Sari Sirait, a public lawyer with LBH Jakarta, most of these complaints have arisen as a result of a lack of personal data protection for users of online loan applications. In this context, it has become widely understood that borrowers’ private data (i.e., identity cards and photos) are being disseminated by the operators of online loan applications.
- Anthonius Malau, Head of the Sub-Directorate for Internet Content Control at the Ministry of Communication and Informatics, stated recently that firm action will be taken against any fintech companies which are caught violating the law. One initiative which is currently being aimed at the prevention of illegal fintech activities is the blocking of illegal fintech activities by the Ministry of Communication and Informatics based on reports which are drawn up by the Financial Services Authorities (OJK). To date, this approach has resulted in some 803 illegal fintech activities being blocked.
- Mr. Malau also stated recently that the government was engaged in a concerted effort to protect consumers through the preparation of various regulations which together will comprise a draft bill on private data protection.
