Government Urged to Pass Draft Bill on Indigenous Communities

  • In spite of the fact that indigenous communities (masyarakat adat) are already recognized under a number of different legal frameworks, including Law No. 32 of 2009 on Environmental Protection and Management, Law No. 41 of 1999 on Forestry (“Forestry Law”)  and Law No. 18 of 2013 on the Prevention and Eradication of Forest Destruction, the Alliance of Indigenous Communities (Aliansi Masyarakat Adat Nusantara – “AMAN”) is emphasizing the fact that, in practice, the protection which is currently being afforded to indigenous communities remains far from adequate.
  • Muhammad Arman from AMAN is also stressing the fact that many of the indigenous lands which are occupied by traditional communities have been lost as a result of plantation and mining activities. As a solution, Mr. Arman is urging the Indonesian Government to conclude deliberations of the Draft Bill on Indigenous Communities (“Draft Bill”).
  • The Indonesian President, Joko Widodo, recently issued an official Presidential Letter which ordered various Ministers to draw up a Problem Inventory List (“DIM”). However, to date, no further information has emerged regarding the progress of the DIM.
