Legal System to Support the Development of Indonesian Digital Technology

  • In order to keep pace with developments in the world of digital technology, the government is currently implementing Regulation of the President No. 74 of 2017 on the Roadmap for the National Electronic Commerce System for the 2017 - 2019 Period (“Regulation 74/2017”), which is aiming to offer guidance on the implementation of e-commerce based the following principles: 1) Transparency for all parties; 2) Legal certainty and protection; 3) Prioritization and protection of the national interest; micro-, small- and medium-scale enterprises; and start-up businesses; and 4) Development of human resources.
  • Digital technology has the potential to generate various new business opportunities as a result of the economics of shared platforms. However, said technologies could also lead to the creation of gaps between businesses. Therefore, in order to develop the digital economy, several matters require attention, including: 1) Support for productive activities; 2) Fostering of inclusivity; and 3) Resolution of development issues.
  • However, several problems still remain as regards the implementation of Regulation 74/2017, including: 1) Data protection; 2) The empowerment of local businesses; 3) Cross-border e-commerce; and so forth.
  • For more on Regulation 74/2017, see ILB No. 3181.
