Freeport Hit with Environmental Sanctions

  • The Minister of Energy and Mineral Resources (“Minister”) has issued Decree No. 1948/30/MEM/2018, which effectively extends Freeport’s Special Mining Business Permits (“IUPK”) until 30 September 2018. In spite of the fact that the Freeport divestment process has yet to be completed, the IUPK will remain valid, so that Freeport’s various production activities can remain operational while the ongoing share acquisition currently being undertaken by PT. Inalum is completed.
  • However, according to Wahyu Wagiman, the Acting Director of ELSAM, Freeport has undertaken 22 activities that violate its AMDAL and which have resulted in national losses being sustained which may ultimately amount to up to 185 trillion. These losses are the result of the following activities: 1) Expansion of the overall size of the Grasberg open pit; and 2) Disposal of toxic waste, including mercury and cyanide.
  • The government is currently deliberating whether the environmental sanctions which have been imposed upon Freeport will also apply to PT. Inalum.
