The Current Status on the Draft Bill on Personal Data Protection

  • Hendri Sasmita Yuda, Head of the Sub-Division for the Formulation of Draft Regulations under the Ministry of Communication and Informatics, recently stated that the Draft Bill on Personal Data Protection (“Draft Bill”)is currently in the internal harmonization stage at the Ministry of Law and Human Rights. Soon after the harmonization process is concluded, the Draft Bill will be handed over to the House of Representatives (“House”).
  • However, Satya Widya Yudha, the Vice Chief of Commission I of the House, has stressed that the Draft Bill should be initiated by the government due to the fact that as we move into 2019, the House will not have adequate resources to push the Draft Bill.
  • Currently, the legal framework for personal data protection is solely addressed under the Regulation of the Minister of Communication and Informatics No. 20 of 2016 on Personal-Data Protection within Electronic Systems (“Regulation 20/2016”). For more information on Regulation 20/2016, see ILB No. 3022.
