Govt. Reregulates Tire-Import Policy

The Ministry of Trade (“Ministry”) has finally reregulated the import of tires through the issuance of Regulation No. 77/M-DAG/PER/11/2016 on Import Provisions for Tires (“Regulation 77/2016).
 
 
Regulation 77/2016 redefines provisions which relate to the types of tires which can be imported, as well as the various requirements which have to be met when importing tires, which were previously regulated under Ministry Regulation No. No. 45/M-DAG/PER/6/2015 (“Regulation 45/2015”).[1] However, on 28 September 2015, the Ministry repealed Regulation 45/2015 through the issuance of Ministry Regulation No. 78/M-DAG/PER/9/2015 (an integral part of the government’s deregulation policy) without ultimately replacing it with any new regulation governing tire imports.[2]
 
Types of Tires
 
The Appendix to Regulation 77/2016 sets out 38 different types of tire which can be imported into Indonesia, and these are classified into three categories, namely: 1) New and pressured tires; 2) Rubber inner tubes; and 3) Motor-vehicle spare parts and accessories. However, Regulation 77/2016 does not apply to any import activities which meet the following criteria:[3]
