New Regulation on Ship Safety Management

The Minister of Transportation has issued Regulation No. PM.45 of 2012 on Ship Safety Management (“Regulation”), which is an implementation of Article 169 of Law No. 17 of 2008 on Shipping (“Shipping Law”).

Article 169 of the Shipping Law stipulates that ship owners and operators of ships that have a certain type and size must follow the requirements on ship safety management and pollution prevention. Compliance is shown by the issuance of a Document of Compliance/DOC for shipping companies and a Safety Management Certificate/SMC for a ship. The Regulation stipulates the procedure on securing a DOC and SMC.
