Delegation of Authority to the BKPM for the Issue of Certain Agricultural Licenses

The previous regulatory framework governing the delegation of authority to the Head of the Capital Investment Coordinating Board (Badan Koordinasi Penanaman Modal / BKPM) to issue certain agricultural licensing documents was deemed to no longer be fit for purpose. The previous regulatory framework was contained in Minister of Agriculture Decision No. 565/Kpts/Org/10/1977. The Minister has issued Decision No. 3480/Kpts/HK.300/10/2009 to repeal and replace the previous regulation.

The decision also facilitates the implementation of Article 26(2) of Law No. 25 of 2009 and Article 7(2) and (3) of Presidential Regulation No. 27 of 2009. For a brief overview of the Presidential Regulation see ILB No. No. 1133 2/7/2009 on “One Stop Integrated Services - Capital Investment Sector”.

The decision contains nine points. These points, among other matters, stipulate the following:

1.

The Minister of Agriculture delegates the authority to issue certain licenses in the agricultural sector within the framework of capital investment to the Head of the BKPM;

2.

The licenses issued by the Head of the BKPM pursuant to this delegation of authority are done so in the name of the Minister of Agriculture;

3.

Before issuing any license the Head of the BKPM must seek a recommendation from the Director General of Commodities from within the Department of Agriculture;

4.

The Head of the BKPM must consider the negative investment list with respect to open and closed sectors / industries for capital investment;

5.

Any licenses issued pursuant to this delegation of authority must also be carbon-copied to the Minister of Agriculture;

6.

The Head of the BKPM must report the licenses issued under this delegation of authority at least once every year to the Minister of Agriculture; and

7.

All licenses issued prior to the coming into force of this decision remain valid until their date of expiry.

The decision has been in force since 8 October 2009.
