Re-Registration Duty for IUIPHHK Holders - Minister of Forestry Regulation

The authority of the Minister of Forestry includes regulating, guiding, and developing primary industry as it relates to forest wood products (industri primer hasil hutan kayu / IPHHK). With a view to improving the regulating, guiding, and developing aspects of this authority the Minister of Forestry has issued Regulation No. P.24/Menhut-II/2009. This regulation addresses the matter of re-registration forest wood product primary industry business licenses (Izin Usaha Industri Primer Hasil Hutan Kayu / IUIPHHK).

The premise of the regulation is to anticipate the impact of the ongoing global crisis, to raise industry competitiveness, and to provide contributions to the growth of the national economy, broaden employment opportunities, and reduce poverty. This will require the re-registration of all current IUIPHHK in order to provide an accurate inventory on matters such as the amount of forest resources available, the size of these resources, production capacity of the available human resources, operational conditions, and assets of all IPPHK as a means of determining the forest industry revitalization policy.

It should be noted that the re-registration obligation only applies to those who have not obtained an Industrial Business License (Izin Usaha Industri) according to Ministerial Decision No. 125/Kpts-II/2009 and its amendments.

It must be noted that the provisions of the regulation are not onerous with regards to compliance and each of the requirements are simply set out. For example, those required to comply with the re-registration of IUIPHHK are set out in Article 4. The documents that must be submitted as part of the re-registration process are set out in Article 5, and Article 6 sets out where the re-registrations are to take place. Finally, Article 7 sets out how the re-registration is to be evaluated and the manner in which the new IUIPHHK is to be issued.

For those re-registration applications that have been submitted based on earlier regulations or decisions and which have not been processed are to be evaluated and re-issued based on the provisions of this regulation. For those IUIPHHK that have already been re-issued based on the earlier regulations and decisions are to remain valid.

The regulation repeals and replaces Minister of Forestry Decision No. 300/Kpts-II/2003 which has been severally and finally amended by Minister of Forestry Regulation No. P.70/Menhut-II/2006.

The Regulation was issued on 1 April 2009 and has been in force since 7 April 2009.
